Olana Kebede et al Vs Federal Prosecution – Summary of Charges

On December 15, 2015, federal prosecutors charged 21 people of Oromo descent are charged under the ATP.  The defendants include students, farmers and businessmen. Since the first major crackdown following the Oromo protests in April 2014, dozens of students were arrested and charged with terrorism. Against the 1st, 2nd, 3rd, 5th and 6th Defendants

The Crime

In Violation of Article 32/1/A of the 2004 FDRE Criminal Code and Article 3/1 and 4 of the Anti-Terrorism Proclamation 652/2009

Specifications

The accused with their full intention of the result of their act and as a principal offender, by joining the self-claimed Oromo Liberation Front(OLF), an organization aims to influence the government and terrorizing the public by disrupting the political, constitutional, economic and social order of the country, by organizing themselves with a terrorist cell, profiling their job and recruiting members, providing supplies for outlaws who reside in the Jungle which is found in West Shewa Zone, Adaberga District near to Olonkomi [town], With the purpose of killing a man called Lebeta Fufa which they label him as a government agent, made preparations and trying a failed attempted homicide with the help of the money they got from the leaders of the terrorist organization. In general they are accused of planning, preparing, conspiring, inciting and attempting of a terrorist act as co-offenders.

Each of the accused participation is as follows:

1st defendant Olana Kebede

After receiving a mission from the 6th defendant and in collaboration with the 2nd defendant he recruit the 4th defendant and made a vow to kill a man called Lebeta Fufa. And with the 3rd and the 5th defendant he studied where Lebeta Fufa lives and after that he gave a pistol and bullets to the 2nd defendant to kill Lebeta Fufa.

2nd defendant Wolde Motuma

After he was recruited as a member of OLF in 2003 e.c, he was elected as the vice leader of the terrorist cell. In collaboration with the 1st, the 3rd and the 6th defendant he plan to kill a man called Lebeta Fufa. For that end he receives a pistol from the 1st defendant and gave it to the 5th defendant. Moreover, he communicated an outlaw called Boki Eshetu and his terrorist network in the jungle and gave him four military uniforms and 3000 Ethiopian Birr to him.

3rd defendant Megersa Fekadu

After accepting a mission from the 6th defendant and elected as a secretary of the terrorist cell he attempt to kill a man called Lebeta Fufa with the 5th defendant.

5th defendant Meseret Aboma

After accepting a mission to kill a man called Lebeta Fufa from the 6th defendant and held a failed attempt — he communicate a leader of OLF called Abdiboru, who is living abroad and asked him money, so it can help them to hide from the law.

6th defendant Abdisa Ifa

He gave a mission for the 1st and the 2nd defendants as well as to the 1st government witness of the case to kill a man called Lebeta Fufa, to contact a leader of a terrorist network Abdiboru, and provide them military uniform which he was hiding before his arrest for an outlaw called Boki Eshetu.

2nd Charge

Against the 4th, 7th, 8th, 17th, 18th and 19th defendants

4th defendant Argemsisa Lenjisa

He was recruited to the terrorist cell by the 1st defendant and elected as an auditor of the cell.

7th defendant Temesgen Tsegaye

After he receives 500 Ethiopian Birr he was recruited as a member of the terrorist cell by the 2nd defendant and introduced to the 1st and the 3rd defendants. And he talk with a guy called Abdi (a leader of the terrorist group) who lives abroad and pass him information.

8th defendant Tekalgn Merdosa

Since November 2006 e.c he was communicating with a guy called Golcha Dargie (who is the leader of the terrorist group in Kenya) and went to Kenya and joins OLF’s military training camp. After he took military and political trainings he accepts a mission to study the security situations of Federal Police Commission, Head Office of National Defense Force and the National Palaces in Addis Ababa. Moreover, he accepts a mission to find a jungle between Addis Ababa and Chancho. After he studied both he report it to a guy called Jaleta Lemi in Kenya. Furthermore, he planned to disrupt Ethiopia’s election 2015 and he meets outlaws in Baruda jungle with the 9th defendant.

17th defendant Jaleta Sendafa

He joins the terrorist cell and recruits the 1st government witness of the case to the cell. And he organizes a meeting among the 2nd, the 8th and the 9th defendants as well as the 1st government witness to conspire a terrorist act.

18th defendant Lakew Robi

He recruits the 1st government witness of the case to the terrorist cell and arranges a meeting between the witness and the 9th defendant. He gave 1000 Ethiopian Birr to the 1st government witness of the case to buy a hand grenade and provide it to the 9th defendant. Moreover he communicated with a guy called Kejelcha (who lives abroad and a leader of OLF) and gives some information about Ethiopian Muslims current protest and reports some causality. He got 20, 500 Ethiopian Birr for what he was doing.

19th defendant Engida Kus

He communicates with the leader of the terrorist group who lives in Kenya and briefed him about the planned terrorist attack before Ethiopia’s Election 2015. He also communicates with the leader of the terrorist group who lives in Uganda and accepts a terrorist mission. Moreover, he call to a guy called Jaleta who lives in Enchini town and inform him to postpone the terrorist act they were planning until they got the proposed money from the OLF leadership.

In general, the defendants are accused of being a member of a terrorist group, organizing themselves in a terrorist cell, accepting a terrorist mission, communicating with the leader of the terrorist organization and taking a terrorism training to commit a terrorist act.

3rd Charge

Against the 9th, 10th, 11th, 12th, 13th, 14th, 15th and 16th defendants

9th defendant Boki Eshetu

He was a member of OLF since 1984 e.c. Since 2004 e.c he introduced with members of the terrorist cell and accepts 1000 Ethiopian Birr to buy hand grenade. In 2007 he recruits Birhanu Boki, Mamush Boki, Dereje Taye, Bokena Tulu, Bokena (Mekonnen) Zewde, Deme Bedada, Worku Gurmu and Geremew Adugna to the terrorist group. And in the same year in a meeting with members of the group he was elected as a leader of the terrorist cell. He also robes a gun from Mr. Ayele Tekelu in May 2007 e.c with his friends. Furthermore, he receives 4 military uniforms and 300 Ethiopian Birr from the 2nd defendant and the 1st government witness of the case.

10th defendant Birhanu Boiki

After he was recruited as a member of the terrorist cell he was elected as a treasure of it. An also he communicate with other members of the group and pass information.

11th defendant Mamush Boki

After he was recruited as a member of the terrorist group by the 9th defendant he participate in a meeting the elect its leaders.

12th defendant Fekadu Adugna

After he was recruited as a member of the terrorist group by the 9th defendant, he participates in a meeting that elects its leaders. And in May 2007 e.c he also robs a gun from Mr. Ayle Teklu with his friends.

16th defendant Dereje Taye

After he was recruited as a member of the terrorist group by the 9th defendant, he participates in a meeting that elects its leaders.

13th defendant Mekonnen Zewde

After he was recruited as a member of the terrorist group by the 9th defendant, he participates in a meeting that elects its leaders. And in May 2007 e.c he also robs a gun from Mr. Ayle Teklu with his friends.

14th defendant Worku Gurmu

After he was recruited as a member of the terrorist group by the 9th defendant, he participates in a meeting that elects its leaders. And help the 9th defendant and co by hiding them after they rob a gun in May 2007 e.c.

15th defendant Geremew Adugna

After he was recruited as a member of the terrorist group by the 9th defendant, he participates in a meeting that elects its leaders. And help the 9th defendant and co by hiding them after they rob a gun in May 2007 e.c.

In general, the defendants are accused of being a member of a terrorist group, organizing themselves in a terrorist cell, accepting a terrorist mission, communicating with the leader of the terrorist organization and taking a terrorism training to commit a terrorist act.

4th Charge

Against the 20th and 21st defendants

[The Crime]

In violation of 32/1/A of the 2004 FDRE Criminal Code Article 32/1/A and Article 8 of The Anti-Terrorism Proclamation No. 652/2009

Specifications

The Defendants are accused of hiding a KS gun and a hand grenade for the 9th defendant with the knowledge of a terrorist act might be committed by it—in their home ceiling and yard.
